General

The Company refers to HYPE SHARKS LTD, a company registered in England and Wales under company number 15980981, with a registered office at Office 10275 182-184 High Street North East Ham, London, United Kingdom, E6 2JA. The Customer refers to any party utilizing the services, products, advice, or goodwill of the Company.

Orders are accepted and services provided subject to the following terms and conditions. All other conditions, warranties, and representations, whether express or implied, statutory or otherwise, except as to title, are excluded. No additions or variations shall apply unless agreed upon in writing by both parties.

Orders

The Company reserves the right to cancel any uncompleted order or suspend delivery if the Customer breaches these terms and conditions. If such a breach is remediable and not remedied within 28 days of notice, cancellation will proceed without prejudice to the Company’s other remedies.

If an order is canceled by the Customer, they shall indemnify the Company against any losses arising from the cancellation.

Prices

Prices are subject to change without notice and are exclusive of VAT and other applicable charges. While every effort is made to ensure price accuracy, the Company is not liable for errors or omissions. Price changes may occur due to currency fluctuations, regulatory changes, or unforeseen circumstances.

Payment

All payments are due in full, without deductions or set-offs, within 30 days of the invoice date unless otherwise agreed. Overdue accounts may incur interest at a rate of 3% per month.

The Company reserves the right to assign unpaid debts to third parties for collection purposes without prior notice. Queries regarding invoices must be raised in writing within 14 days of the invoice date.

Delivery and Risk

Delivery dates are estimates and not binding. The Company is not liable for delays caused by suppliers, carriers, or external factors. Risk in the goods passes to the Customer upon delivery. Customers must notify the Company of any damages or discrepancies within two days of receipt.

Title to goods remains with the Company until full payment is received.

Warranties and Liability

The Company warrants that its services and goods will conform to the agreed specifications. Liability for defects is limited to repair, replacement, or a refund of the purchase price. The Company is not liable for:

• Misuse, neglect, or unauthorized alterations.
• Issues arising from third-party specifications provided by the Customer.
• Any indirect, consequential, or incidental damages.

Data Protection

HYPE SHARKS LTD handles Customer data in strict compliance with applicable data protection laws, including the UK GDPR. By engaging with the Company, the Customer consents to the use of their data as outlined in the Privacy Policy. Force Majeure

The Company is not liable for delays or non-performance caused by events beyond its control, including but not limited to natural disasters, strikes, pandemics, or government actions.

Jurisdiction

These terms are governed by English law, and any disputes shall be subject to the exclusive jurisdiction of the English courts.
